ข้อตกลงและเงื่อนไขการให้บริการ

การที่ท่านเข้าใช้งานระบบและอุปกรณ์ของ Spender Network ถือว่าท่านได้อ่าน ทำความเข้าใจ และยอมรับข้อตกลงและเงื่อนไขดังต่อไปนี้ทุกประการ:

• 1. สถานะของผู้ให้บริการ (Service Provider Status) Spender Network ทำหน้าที่เป็นเพียง "ผู้ให้บริการโครงข่ายและแพลตฟอร์มการสื่อสาร" เท่านั้น ทางบริษัทไม่มีส่วนเกี่ยวข้อง ไม่มีอำนาจควบคุม และไม่สามารถเข้าถึงเนื้อหา ข้อความ หรือกิจกรรมใดๆ ที่ผู้ใช้บริการสื่อสารผ่านระบบจัดการและอุปกรณ์ของบริษัท
• 2. ความรับผิดชอบของผู้ใช้บริการ (User’s Sole Responsibility) ผู้ใช้บริการต้องรับผิดชอบแต่เพียงผู้เดียวต่อกิจกรรม เนื้อหา และผลกระทบใดๆ ที่เกิดขึ้นจากการใช้งานอุปกรณ์และระบบของบริษัท ทางบริษัทจะไม่รับผิดชอบต่อความเสียหายทางธุรกิจ การสูญเสียรายได้ หรือผลพวงทางกฎหมายใดๆ ที่เกิดจากการสื่อสารที่ผิดพลาด ความล่าช้า หรือการนำระบบไปใช้ในทางที่ผิด
• 3. ข้อห้ามในการใช้งาน (Prohibited Activities) ผู้ใช้บริการตกลงที่จะไม่นำอุปกรณ์ ซิมการ์ด และแพลตฟอร์มของบริษัทไปใช้ในทางที่ผิดกฎหมาย ซึ่งรวมถึงแต่ไม่จำกัดเพียง: การวางแผนหรือประสานงานเพื่อก่ออาชญากรรม การฉ้อโกง การหลอกลวง การดักฟัง การแทรกแซง หรือการละเมิดสิทธิส่วนบุคคล (PDPA) ของผู้อื่น
• 4. ความพร้อมให้บริการและเหตุสุดวิสัย (Service Availability & Force Majeure) การให้บริการอาจมีข้อจำกัด ความล่าช้า หรือขัดข้องชั่วคราว อันเนื่องมาจากความขัดข้องของเครือข่ายโทรศัพท์เคลื่อนที่ (Network Operator) ภัยธรรมชาติ หรือเหตุสุดวิสัยอื่นใดที่อยู่นอกเหนือการควบคุมของบริษัท ทางบริษัทจะไม่รับผิดชอบต่อความเสียหาย การสูญเสียกำไร หรือการเสียโอกาสใดๆ ที่เกิดจากเหตุเครือข่ายขัดข้อง หรือระบบไม่สามารถใช้งานได้ชั่วคราวในทุกกรณี
• 5. ข้อจำกัดของซิมการ์ดและอุปกรณ์ (SIM Card & Device Restrictions) ซิมการ์ดระบบของบริษัทถูกออกแบบมาเพื่อใช้งานกับเครื่องมือสื่อสารของ Spender Network เท่านั้น ห้ามนำไปใส่ในอุปกรณ์อื่น หากฝ่าฝืนจนเกิดความเสียหาย ผู้ใช้บริการจะต้องชำระค่าบริการเปลี่ยนซิมใหม่ และห้ามผู้ใช้บริการโอนสิทธิการใช้งานให้บุคคลภายนอกโดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษรจากบริษัท
• 6. สิทธิในการระงับการให้บริการ (Right to Suspend/Terminate Service) บริษัทขอสงวนสิทธิ์ในการระงับ หรือยกเลิกการให้บริการอุปกรณ์ แพลตฟอร์ม หรือซิมการ์ดทันทีโดยไม่ต้องแจ้งให้ทราบล่วงหน้า และไม่ต้องคืนเงินค่าบริการ หากบริษัทตรวจพบหรือมีเหตุอันควรเชื่อได้ว่า ผู้ใช้บริการละเมิดข้อตกลงและเงื่อนไขฉบับนี้
• 7. การเปลี่ยนแปลงเงื่อนไข (Amendments to Terms & Conditions) บริษัทขอสงวนสิทธิ์ในการแก้ไข ปรับปรุง หรือเปลี่ยนแปลงข้อตกลงและเงื่อนไขนี้ได้ตลอดเวลา การที่ผู้ใช้บริการยังคงใช้งานระบบต่อไปหลังจากมีการเปลี่ยนแปลง ถือว่าท่านยอมรับเงื่อนไขใหม่โดยปริยาย หากท่านไม่ยินยอมหรือไม่เห็นด้วยกับเงื่อนไขใหม่ สิทธิเดียวที่ท่านมีคือการยุติการใช้งานและแจ้งยกเลิกบริการทันที โดยบริษัทจะไม่รับผิดชอบในการคืนเงินหรือชดเชยความเสียหายใดๆ ทั้งสิ้น

By accessing and using Spender Network's systems and devices, you acknowledge that you have read, understood, and agreed to the following terms and conditions:

• 1. Service Provider Status Spender Network acts solely as a "Communication Network and Platform Service Provider." The Company is not involved in, has no control over, and does not monitor or access the content, messages, or activities communicated by the User through our systems and devices.
• 2. User’s Sole Responsibility The User is solely responsible for any activities, content, and consequences arising from the use of the Company's devices and systems. The Company shall not be held liable for any business damages, loss of revenue, or legal repercussions resulting from miscommunication, delays, or the misuse of the system.
• 3. Prohibited Activities The User agrees not to use the Company's devices, SIM cards, and platform for any illegal purposes, including but not limited to: planning or coordinating crimes, fraud, scams, wiretapping, interfering with, or violating the privacy rights (PDPA) of third parties.
• 4. Service Availability & Force Majeure Services may be subject to limitations, delays, or temporary outages due to mobile network operator failures, natural disasters, or other force majeure events beyond the Company's control. The Company shall not be held liable for any damages, loss of profit, or missed opportunities resulting from network downtime, signal loss, or temporary service unavailability under any circumstances.
• 5. SIM Card & Device Restrictions The Company's system SIM cards are designed exclusively for Spender Network communication devices. Use in other unauthorized devices is strictly prohibited. If a violation causes damage, the User must pay for a replacement SIM. Transferring usage rights to a third party without the Company's written consent is also strictly prohibited.
• 6. Right to Suspend/Terminate Service The Company reserves the right to immediately suspend or terminate the device, platform, or SIM card services without prior notice and without refund if it detects or has reasonable grounds to believe that the User has violated these Terms and Conditions.
• 7. Amendments to Terms & Conditions The Company reserves the right to amend, update, or modify these Terms and Conditions at any time. Continued use of the service after such modifications constitutes the User's implicit acceptance of the new terms. If the User does not agree with or objects to the revised terms, their sole remedy is to discontinue the use of the system and terminate the service immediately, without any right to refunds or compensation from the Company.
